SUBJECT: Amendment to Revenue Agreement with the California Department of Public Health
for the CalFresh Healthy Living program and related Agreements
RECOMMENDED ACTION(S):
1. Approve and authorize the Chairman to execute Amendment No. 19-10323,A01 with the
California Department of Public Health Nutrition Education and Obesity Prevention Branch
Supplemental Nutrition Assistance Program-Education,for the CalFresh Healthy Living
Program, extending the term by one year from October 1,2022 to September 30, 2023 and
increasing the maximum by$1,786,482 to a total of$7,145,928;
2. Approve and authorize the Chairman to execute Amendment No. 5 to Agreement with Fresno
County Superintendent of Schools,for nutrition education services related to the school
wellness program activities, extending the term by one year from October 1, 2022 to

There is no increase in Net County Cost associated with the recommended actions as the costs are fully
funded by the Nutrition Education and Obesity Prevention (NEOP) Branch Supplemental Nutrition
Assistance Program-Education (SNAP-Ed)grant provided by the California Department of Public Health
(CDPH).Approval of the first recommended action will extend the term of the CalFresh Healthy Living
Program (CalFresh)grant by one year with additional funding to allow the CalFresh program to continue
providing nutrition education activities and interventions to low-income County residents. Approval of the
second recommended action will extend the term by one year and increase the maximum to allow Fresno
County Superintendent of Schools (FCSS)to continue providing school wellness activities through FFY
2022-23. Approval of the third recommended action with California Health Collaborative (CHC)will extend
the term by one year and modify the budget to add a new bilingual part-time staff position,with no change to
the maximum compensation. Approval of the last recommended action with California State University
(CSU), Fresno Foundation through its Central Valley Health Policy Institute will extend the term by one year
to allow CSU Fresno Foundation to continue providing comprehensive evaluation education and obesity
prevention services for the NEOP CalFresh Program, with no change to the maximum compensation.This

ALTERNATIVE ACTION(S):
Should your Board not approve the recommended actions, the Department would be unable to fund the
NEOP Program and its related subcontracts for the additional extension year which could impact the
completion of required CalFresh grant activities and put the program at risk for non-compliance with the
CDPH.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended actions.The first recommended
action will increase the NEOP CalFresh grant maximum by$1,786,482 for FFY beginning October 1, 2022
through September 30, 2023; $7,145,928 for the term. This increase will cover contractual costs, staffing,
services, and supplies in support of program activities and interventions. The total cost for the second
recommended action with FCSS is$336,500 for FFY 2022-23; $2,229,000 for the term. The total cost for
the third recommended action with CHC is$311,603 for FFY 2022-23; $1,558,015 for the term. The total
cost for the fourth recommended action with CSU Fresno Foundation is$108,000 for FFY 2022-23;
$540,000 for the term. Sufficient appropriations and estimated revenues are included in the Department's
Org 5620 FY 2022-23 Adopted Budget.
DISCUSSION:
On September 24, 2019, your Board approved the 2019-2022 NEOP SNAP-Ed CalFresh revenue
agreement to allow the Department to support nutrition education and obesity prevention activities and
interventions for low-income County residents. Approval of the first recommended action will extend the term
of the NEOP CalFresh grant agreement one year with additional funding to ensure that by September 30,
2023, Fresno NEOP will have:
• Provided individual direct educational strategies to promote healthy eating, food resource
management, and/or physical activity to 15,246 CalFresh eligible residents in Fresno;
• Work with and/or support 43 partners and 7 coalitions in support of increased healthy eating and
physical activity behavior and access;
• Work in 30 sites to engage the CalFresh community in program planning and implementation, and
15 sites will put sustainability measures in place to ensure changes to support healthy eating and
physical activity are continued.
On December 13, 2016, your Board approved Agreement No. 16-698 with FCSS to provide nutrition
education activities in classrooms and afterschool programs in targeted low-income County communities.
On June 20, 2017, your Board approved First Amendment No. 16-698-1 to increase the maximum to expand
the school wellness services. On May 12, 2020, your Board approved Second Amendment No. 16-698-2 to
revise the scope of work to increase community training events and redistribute budget line items to
correspond with the revised scope of work. On August 10, 2021, your Board approved Third Amendment
No.16-698-3 to extend the term and increase the maximum by$336,500 to continue providing the school
wellness activities during COVID-19 pandemic. On December 14, 2021, your Board approved Forth
Amendment No.A-21-543 to revise the budget to offset FCSS salary increases without increasing the
maximum compensation.Approval of the second recommended action will extend the term by one year and
increase the funding to ensure FCSS will continue to provide and complete the same school wellness
activities that were delayed due to the COVID-19 pandemic closures to public schools that started in March
2020.
On September 24, 2019, your Board approved Agreement No. A-19-473 with CHC for healthy retail, and
healthcare clinic and hospital obesity prevention services. Approval of the third recommended action will
allow CHC to continue to provide the healthy retail activities with local retail vendors and complete the

obesity prevention activities with local healthcare clinics and hospitals that were delayed due to COVID-19
business closures and the restrictions on how businesses could operate moving forward.
On February 26, 2019, your Board approved Agreement No.A-19-099 with CSU, Fresno Foundation, for
required evaluation education and obesity prevention services for the Department's NEOP CalFresh
program. Approval of the fourth recommended action will ensure CSU, Fresno Foundation can continue to
provide the evaluation activities in the targeted communities in the County that were delayed or restricted
from occurring as a result of the COVID-19 pandemic.
It is the intention of the funder, that this extra year will provide the time needed to complete any activities that
the COVID-19 pandemic may have interrupted and continue providing the same services from the FFY 2023
Integrated Work Plan.

1 AMENDMENT I TO AGREEMENT
2 THIS FIRST AMENDMENT TO AGREEMENT (hereinafter "Amendment") is made and
3 entered into this 20th day of September , 2022, by and between COUNTY OF FRESNO, a
4 Political Subdivision of the State of California, Fresno, California (hereinafter "COUNTY"), and
5 CALIFORNIA STATE UNIVERSITY— FRESNO FOUNDATION, a Private Non-Profit Organization,
6 whose address is 4910 N. Chestnut Avenue, Fresno, California, 93726, hereinafter referred to as
7 "CONTRACTOR".
8 WITNESSETH:
9 WHEREAS, COUNTY and CONTRACTOR entered into Agreement number A-19-099,
10 dated the 2611 of February 2019 (hereinafter"Agreement"), pursuant to which CONTRACTOR agreed
11 to provide comprehensive evaluation services of the nutrition education services and policy system, and
12 environmental (PSE) change efforts of the Department's existing Nutrition Education and Obesity
13 Prevention (NEOP) program; and
14 WHEREAS, CONTRACTOR, through its Central Valley Health Policy Institute, has the
15 facilities, equipment and personnel skilled in the provision of such evaluation services; and
16 WHEREAS, COUNTY and CONTRACTOR now desire to amend the Agreement to
17 modify the budget and extend the term as stated below and restate the Agreement in its entirety.
18 NOW, THEREFORE, for good and valuable consideration, the receipt and adequacy of
19 which is hereby acknowledged, COUNTY and CONTRACTOR agree as follows:
20 1. That all references in the Agreement to "Exhibit C", shall be changed to read
21 "Revised Exhibit C". Revised Exhibit C is attached hereto and incorporated herein by this reference.
22 2. That Paragraph Two (2)—Term, of the Agreement , on Page Two (2), shall be
23 deleted in its entirety and replaced with the following:
24 "2. TERM: The term of this Agreement shall commence on February 26,
25 2019 and will terminate on September 30, 2023."
26 COUNTY and CONTRACTOR agree that this First Amendment is sufficient to amend the
27 Agreement, and that upon execution of this First Amendment, the Agreement and this First
28 Amendment together shall be considered the Agreement.

1 The parties agree that this First Amendment may be executed by electronic signature
2 as provided in this section. An "electronic signature" means any symbol or process intended by an
3 individual signing this Amendment to represent their signature, including but not limited to (1) a digital
4 signature; (2) a faxed version of an original handwritten signature; or (3) an electronically scanned and
5 transmitted (for example by PDF document) of a handwritten signature. Each electronic signature
6 affixed or attached to this Amendment (1) is deemed equivalent to a valid original handwritten
7 signature of the person signing this Amendment for all purposes, including but not limited to
8 evidentiary proof in any administrative or judicial proceeding, and (2) has the same force and effect as
9 the valid original handwritten signature of that person. The provisions of this section satisfy the
10 requirements of Civil Code section 1633.5, subdivision (b), in the Uniform Electronic Transaction Act
11 (Civil Code, Division 3, Part 2, Title 2.5, beginning with section 1633.1). Each party using a digital
12 signature represents that it has undertaken and satisfied the requirements of Government Code
13 section 16.5, subdivision (a), paragraphs (1) through (5), and agrees that each other party may rely
14 upon that representation. This Amendment is not conditioned upon the parties conducting the
15 transactions under it by electronic means and either party may sign this Amendment with an original
16 handwritten signature.
17 The Agreement, as hereby amended, is ratified and continued. All provisions, terms,
18 covenants, conditions, and promises contained in the Agreement and not amended herein shall
19 remain in full force and effect.

NEOP Nutrition Education Budget Instructions
Position Title: Identify the employee's position title.
Name: Identify the employee's name associated with the title. If vacant, enter"vacant." Once the
position is filled, insert a name and submit to the funding agency.
FTE: Enter full-time equivalent prorated based on percentage of time they will work throughout the
funding year. Note: if an employee does not work an entire 12 months, or is not employed full
time,their FTE should not be 1.0.
SNAP-Ed Time Spent: Identify percent SNAP-Ed time spent on direct delivery and on administrative duties.These two
columns must equal 100%, even for less than 1.0 FTE employees.
Administrative duties include processing purchase orders, preparing invoices, collecting time
and effort reports, and general clerical services such as answering phones, ordering supplies,
preparing correspondence, etc.
Direct delivery duties include nutrition education in the classroom, food demonstrations,
community outreach activities, physical activity promotion, nutritional aspects of gardening, etc.
Annual Salary: Identify salary only, not including benefits. When converting a monthly,weekly, hourly, etc.,
salary, use the standard 52 week year or 2080 hours/year to make the calculation.
Total SNAP-Ed Salary: This will automatically calculate based on annual salary and FTE.
Benefit Rate: Enter the percentage rate of benefits.This can be different for individual positions. Identify what
costs are included in the benefit rate beneath the staffing table.
Total SNAP-Ed Benefits: This will automatically calculate based on total SNAP-Ed salary and benefit rate.
SNAP-Ed Admin Costs: This will automatically calculate based on FTE, percent SNAP-Ed time spent on
management/administrative duties, and total SNAP-Ed funded salary and benefits.
