1 AMENDMENT ITO AGREEMENT
2 THIS AMENDMENT I TO AGREEMENT, ("Amendment I"), is made this 12t" day of
3 July , 2022 ("Effective Date"), by and between the COUNTY OF FRESNO, a political
4 subdivision of the State of California ("County"), and the CITY OF KERMAN ("City").
5 WITNESSETH
6 WHEREAS, the County has received funds to administer and implement the program for
7 the Community Development Block Grant Coronavirus Response ("CDBG-CV") Program activities
8 of the County, and its participating cities, in accordance with the provisions of Title I of the Housing
9 and Community Development Act of 1974, as amended ("HCD Act"), the Coronavirus Aid, Relief,
10 and Economic Security Act, ("CARES Act"); Public Law 93-383; and the laws of the State of
11 California; and
12 WHEREAS, on December 15, 2020, the County and the City entered into Agreement 20-
13 515, ("Agreement"), whereby $77,559 in CDBG-CV funds were made available to the City for the
14 Kerman Food Bank, Project No. 19371-CV ("Project"); and
15 WHERAS, on January 28, 2022, the Director approved an extension to the close out date
16 of the project to June 30, 2023, per the terms of Section VI I, Paragraph D; and
17 WHEREAS, the City now has an additional $35,540.63 from its allocation of CDBG-CV
18 funds that may be made available to the Project; and
19 WHEREAS, the City has requested these additional CDBG-CV funds in the amount of
20 $35,540.63 be made available to the Project for the purposes of this Agreement.
21 NOW THEREFORE, in consideration of their mutual promises as hereinafter set forth, the
22 City and the County agree to amend the Agreement as follows:
23 1. Page 1, Lines 17-19, is amended to read:
24 "WHEREAS, the Subrecipient has estimated that the total cost of the Project is
25 $113,099.63, and has requested the sum of $113,099.63 from the County's allocation of CDBG-
26 CV funds to complete the Project; and"
27 2. The Project description on Page 1, Line 28, and Page 2, Lines 1 and 2, is amended
28 to read:

1 "The Project consists of the procurement and distribution of additional food
2 through the Kerman Food Bank for low- and moderate-income citizens in the City impacted by
3 COVID-19. The Project may also include the procurement and distribution of personal protective
4 equipment (PPE) and infectious disease test kits. The Project will assist residents in obtaining
5 adequate nutrition, and help prevent the spread of infectious disease."
6 3. The budget for the Project on Page 2, Lines 7 and 8, is amended to read:
7 " Food, PPE, and Test Kit Procurement $113,099.63
Total $113,099.63"

9 4. The proposed funding summary for the Project on Page 2, Lines 14 and 15, is
10 amended to read:
11 "CDBG-CV $113,099.63
Local Contribution $ 0
12 Total $113,099.63"
13 5. That the dollar figure set forth on Page 2, Line 11, Page 3, Lines 1 and 21, and
14 Page 7, Line 9, of the Agreement, is amended to read "$113,099.63".
15 County and City agree that this Amendment I is sufficient to amend the Agreement,
16 and that upon execution of this Amendment I, the Agreement and this Amendment I together shall
17 be considered the Agreement.
18 The Agreement, as hereby amended, is ratified and continued. All remaining provisions,
19 terms, covenants, conditions, and promises contained in the Agreement shall remain in full force
20 and effect.
