a CARDLOCK USE AGREEMENT

Between SILVAS OIL COMPANY. INC an ereinafter called
USER). USER represents to SILVAS OIL CO. that USER and all USER'S employees and agents who
would use SILVAS OIL CO property and equipment have been instructed in the safe and proper use of
SILVAS OIL CO.'s fuel dispensing facilities and have been familiarized with the location and function of
the emergency equipment provided by SILVAS OIL CO Further. USER and all of USER's employees
and agents will comply with the following rules and regulations:
a. Smoking is prohibited within 50 feet of dispensers.
b. Dispensing fuel into any container not approved by the Fire Marshal is prohibited.
C. Fueling Vehicles with pilot lights operating is prohibited
d. Engines must be turned off before fueling.
USER agrees to defend, indemnify and hold SILVAS OIL COMPANY, INC. free and harmless from any
and all claims, actions, losses, damages, injuries, liabilities and costs (including attorney's fees)
resulting from negligence or misuse of SILVAS OIL CO 's property and equipment by USER or USER's
employees and agents.
USER hereby accepts the obligation and responsibility for payment of all charges registered to cardlock
access cards issued to USER. Should any of the cards issued to USER be lost or stolen. USER shall
remain liable for all charges incurred after such loss or theft until SILVAS OIL CO. is notified.
Notification may be made verbally at: 805 288.5477, but must be confirmed in writing within 24 hours
and received by SILVAS OIL CO.. 2000 Cabot Place, Ste A, Oxnard, CA 93032, Attn CARDLOCK
DEPARTMENT.
Should USER activate the wrong pump, USER agrees to clear. as well as shut pump off before
proceeding with the correct pump.
Cardlock accounts are billed on a semi-monthly basis with net 15-day terms. Finance charges
are assessed on past due invoices at 1 %%per month.
If USER's account is locked out for reason of delinquency, all monies owed plus a reactivation
fee of$25.00 must be paid before the account will be reactivated. SILVAS OIL CO. reserves the
right to refuse to reactivate past due accounts. If USER's account must be referred to
collection, USER agrees to pay collection costs and attorney's fees incurred by SILVAS OIL CO.
USER agrees to a $5.00 charge for each replacement of a lost or stolen card, a charge of$1.50
for all additional cards or card modifications, including but not limited to locking and unlocking
cards.
USER agrees to keep pin numbers separate from all cards issued. SILVAS OIL CO. is not
responsible for any fuel obtained on a lost or stolen card.
USER agrees to destroy and dispose of old card(s) when remakes are requested.
Any of the terms in this agreement are subject to change upon written notice by SILVAS OIL CO. to
user If USER uses any cards after receipt of such notice, then USER's consent to such terms shall be
implied.

By signing below, I am confirming that I understand and am in agreement with the below
differences in relation to the Fleetwide Fuel Access Card (hereafter known as 'Fleetwide Card')
vs. the traditional CFN Fuel Access Card (hereafter known as 'CFN Card'.)
1. Fleetwide Card PIN numbers are 5 digits, CFN Card PIN numbers are 4 digits.
2. The Manual Entry option does not apply to the Fleetwide Card.
3. A 40-gallon limit is hard coded onto each Fleetwide Card. A custom per-fill limit can be
requested, but may not function at all types of fueling stations, or a CFN station in local
mode.
4. Security:
a. The product/gallon restriction capabilities may not function at all types of fueling
stations, or a CFN station in local mode, at this time. Due to the Multiple Product
Dispensers (MPDs) at some locations, we cannot limit the type of fuel/gallons a
fuel access card can obtain. Silvas Oil Company, Inc. will not be responsible for
unauthorized prod uct(s)/gaI Ion(s) obtained at a fueling station with MPDs, at
CFNnet/POS stations, or CFN stations in local mode. There will be no reversal or
credit given for unauthorized prod uct(s)/gaI Ion(s) obtained.
b. Non-fuel transactions could be authorized. This may occur on a single"non-fuel"
product transaction, or if there are multiple products on 1 transaction. For
example, the driver purchases fuel and is subsequently prompted for a non-fuel
product (e.g. car wash, retail item, etc.). Since the fuel transaction was
authorized, the non-fuel product will be appended to the completed authorized
fuel transaction. Silvas Oil Company, Inc. will not be responsible for any "non-
fuel" product obtained on a Silvas Oil Fuel Access Card. There will be no reversal
or credit given for any non-fuel product(s) obtained.
c. CFN Cards and CFN/FLEETWIDE Cards are NOT CREDIT CARDS, they are FUEL
ACCESS CARDS.
d. USER must notify SILVAS OIL COMPANY, INC. in the event of card
loss/theft/misuse within 24 hours from date of loss/theft/misuse. SILVAS OIL
COMPANY, INC. IS NOT RESPONSIBLE FOR PRODUCTS/GALLONS OBTAINED ON
A LOST/STOLEN/MISUSED FUEL ACCESS CARD. DO NOT WRITE PIN ON OR
NEAR CARD(S). A Fuel Access Card may only obtain products/gallons if
the assigned PIN, for that specific card, is entered/provided at time of
use.
Any of the terms in this agreement are subject to change. By using Silvas Oil Fuel Access Card(s) you
agree with the terms herein, or as stated on www.silvasfuels.com at time of use, later terms shall apply.
Not all fe tures and/or controls are offered at all fueling stations or cardlocks.
