HomeMy WebLinkAboutAgreement A-22-137 with B.H. 1821 Fulton Street LLC.pdfL-127 DSS Fulton 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 COUNTY OF FRESNO Fresno, California 1 SECOND AMENDMENT THIS SECOND AMENDMENT (“Second Amendment”) is made and entered into this_____ day of _______________, 2022 (the “Effective Date”), by and between B.H. 1821 FULTON STREET, LLC, a California limited liability company, located at 11111 Santa Monica Blvd, Ste. 600, Los Angeles, CA 90025, (“LESSOR”), and the COUNTY OF FRESNO, a political subdivision of the State of California, located at 333 W. Pontiac Way, Clovis, CA 93612 (“Lessee”). LESSOR and LESSEE may be referred to in this Lease individually as a “Party” or collectively at times as the “Parties”. WHEREAS, LESSOR and LESSEE are Parties to that certain Lease Agreement No. 15-340, dated July 14, 2015 (the “Lease”), and Assignment No. 15-340-1, dated March 10, 2020 (the “Assignment”), for 20,560 square feet of office space at the property at the location commonly known as 1821 Fulton Street, Fresno, CA 93721 (the “Premises”); and WHEREAS, the Lease will expire on June 30, 2022; and WHEREAS, LESSOR and LESSEE desire to extend the term of the Lease and increase the rental amount for the additional three months of the extended term.. NOW, THEREFORE, in consideration of their mutual covenants and conditions, the Parties agree as follows: 1.Section 3, page 1, lines 20-21, of the Lease is deleted, and the following is added: “current term of this LEASE. The term of the Lease shall continue under the same terms and conditions for three (3) months, commencing on July 1, 2022, through and including September 30, 2022 (the “Extended Term”).” 2. The following is added at the end of Section 4 of the Lease: “LESSEE shall pay to LESSOR Base Rent for the Premises for the Extended Term on or before the first of each month according to the following schedule: Lease Period Rent Per Month July 2022 $ 32,482.67 August 2022 $ 32,482.67 September 2022 $ 32,482.67 5 April Agreement No. 22-137 th 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 COUNTY OF FRESNO Fresno , California L-127 DSS Fulton The Lease, as hereby amended , is ratified and continued. All provisions , terms , covenants, conditions and promises contained in the Lease and not amended herein shall remain in full force and effect.
