EXPERT WITNESS AGREEMENT

THIS AGREEMENT, made and entered into this /3 day of erd ,
2007, by and between the COUNTY OF FRESNO, a political subdivision of the State of
California, hereinafter called "COUNTY", and RIDER LAND & DEVELOPMENT, LLC,
15705 E. Richwood Avenue, Fountain Hills, Arizona 85268, hereinafter called
"CONSULTANT."
WITNESSETH:
WHEREAS, the COUNTY desires to acquire certain real property for
reconstruction of Friant Road, and has filed sixteen eminent domain actions in order to
effect the acquisitions;
WHEREAS, the CONSULTANT'S professional services are needed as an expert
witness to assist the COUNTY in assessing the condemnees' claims of alleged
entitlement to compensation on the theory that their larger parcels are suitable for
development to highest and best uses which are superior to the existing uses.
NOW, THEREFORE, in consideration of the covenants and conditions of the
parties hereinafter expressed, it is agreed as follows:
1. SERVICES
Upon request of COUNTY, CONSULTANT shall, as necessary, attend pretrial
conferences, provide consultation and advice to COUNTY'S attorneys, and testimony at
depositions, and/or trial concerning the parcels affected by the eminent domain actions. -
2. PAYMENT
For services requested by COUNTY, CONSULTANT shall be paid at a rate of
$350.00 per hour for Court appearances or depositions and $200.00 per hour for all other
services, including travel time, provided by CONSULTANT. CONSULTANT shall not bill
for more than eight hours in any day. The hourly rate shall include clerical support,
overhead costs, general and administrative costs and profit. Compensation to
CONSULTANT for all such services shall not exceed FORTY THOUSAND DOLLARS
($40,000). Consultant may bill on a monthly basis.
